DRAFT — OWNER / LEGAL REVIEW REQUIRED before enforcement. Published for transparency; the definitive terms will replace this after review.

Terms of Service

Last updated: August 26, 2026.

1. Agreement

These Terms of Service ("Terms") govern your use of the ShipForge website and any product delivered through it. By using ShipForge you agree to these Terms and to the Privacy Policy. ShipForge is operated by Nei Cescon (Massachusetts, USA).

2. What ShipForge is

ShipForge is a launch-readiness review service for mobile apps. Its Founding Beta offers — the Automated Launch Doctor Review and the Store Launch Pack — are automated, evidence-backed review services: our scanners and AI examine the application you submit (during Founding Beta, you submit your project as a ZIP upload; automated GitHub App is planned and listed in §3) and deliver an evidence-backed report and, where applicable, store-listing assets. ShipForge does not build your application for you, does not host your app, and does not guarantee store approval or compliance — our review is an automated assessment, not a certification from Apple, Google, or any other third party.

3. What is not yet live

Features labelled "Coming soon" or "Roadmap" (including the automated GitHub App upload, the AI Team, the AI Gateway, deterministic connected scanners, the Quality Judge, and future Launch Packs) are described for transparency and are not part of the product you receive today. During Founding Beta, paid delivery runs through the waitlist rather than fully self-serve checkout. We will only mark a feature as live once it has passed our internal Quality Gate.

4. Accounts

You are responsible for keeping the email address and any credentials on your ShipForge account secure. You must not use another person's account or impersonate anyone.

5. Payments

When paid plans open, purchases are processed by Lemon Squeezy under their terms. Prices are in USD unless stated otherwise. Applicable sales tax / VAT is added at checkout by Lemon Squeezy where required.

6. Service scope and licenses

Founding Beta purchases (Launch Doctor Review, Store Launch Pack, Bundle) are one-time paid services described on the License page, which governs how you may use the deliverable you receive. Earlier downloadable source-code tiers (Indie, Pro, Studio) are retired and not sold during Founding Beta.

7. Refunds

Refunds are governed by the Refund Policy.

8. Acceptable use

You must not: (a) resell or redistribute a ShipForge deliverable, report, or template output as a competing product or service; (b) attempt to bypass the Quality Gate, entitlement, or checkout checks; (c) submit an application you do not have the rights to have reviewed; (d) use ShipForge to build or ship apps that violate applicable law, including data protection, consumer protection, or intellectual-property law; (e) present a ShipForge review as an official certification or store approval.

9. Third-party services

ShipForge uses or may integrate with third-party services (e.g. Supabase, Firebase, RevenueCat, Cloudinary, PostHog, Sentry, Lemon Squeezy, and AI providers). Not every listed integration or related capability is customer-available during Founding Beta; the product and status pages identify what is live. Where a third-party service processes your data, its own terms and privacy policy also apply, and its availability is outside our control.

10. Intellectual property

ShipForge retains ownership of its review methodology, scanner, report templates, evaluation rubrics, codebase, tools, documentation, marks and website. You retain full ownership of the application and source code you submit for review, and of the deliverable produced for that application, subject to the applicable License.

11. Disclaimers

ShipForge is provided "as is." Our reviews reflect our team's assessment at the time of scanning and are not a guarantee of App Store or Google Play approval, of any specific business outcome, or that every defect in your application will be found. Where evidence is insufficient to confirm a finding, we mark it "Review required" rather than asserting a defect. Store approval and legal compliance remain your responsibility.

12. Limitation of liability

To the maximum extent permitted by law, ShipForge, its founder, and its suppliers are not liable for indirect, incidental, consequential, special, or exemplary damages, or for any lost profits, revenues, data, or goodwill. Total aggregate liability is limited to the amount you paid to ShipForge in the 12 months preceding the event giving rise to the claim.

13. Termination

We may suspend or terminate access if you materially breach these Terms. On termination, the license grants and refund policy continue to apply according to their terms.

14. Changes

We may update these Terms. Material changes will be posted here and, when we hold your email, sent to you directly.

15. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict-of-laws rules. Disputes will be brought exclusively in the state or federal courts located in Middlesex County, Massachusetts, unless mandatory consumer-protection law of your residence provides otherwise.
